The Basic Elements of a Written Contract In Rwanda

Within the Rwandan Jurisdiction, it is very important for both the employer and the employee to be on the same page before the employee offers his or her service to the employer. One of the cardinal methods for both parties to be on the same page is reaching a conclusive agreement and an employment contract is procured for that purpose. The Rwandan Labor Law defines an employment contract as an agreement between an employer and an employee whereby an employee undertakes to work under the authority of the employer in return for remuneration.
The employment contract then outlines the details of the job which includes who, what, where, when, why, and how of the job, and forms the basis of the working relationship between the employer and the employee. In Rwanda, there are several essential elements of an employment contract that you need to know about as an employer or an employee and of course, has to be included in the employment contract and are as follows;
- The parties (the employee and employer);
- The purpose of the contract;
- The obligations of contracting parties;
- The duration of the employment contract;
- The nature of the employment;
- The category or level of employment;
- The place of work;
- The probation period;
- The working hours for the employee;
- The salary and fringe benefits for the said employee;
- Any deductions on the salary of the employee;
- The date and place of payment of the salary;
- Any overtime remuneration;
- The procedures of transfer of an employee;
- The dispute settlement procedure;
- The procedures for termination of the employment contract; and
- The date of commencement of the employment contract.
It is important to note that both parties that is the employee and the employer has to must accept the terms and agreements of the employment contract to have a binding arrangement.
